New Lenox Boy Falls in Hole & His Mom Sues Village

The Village of New Lenox should have covered the hole, the lawsuit said.

A New Lenox woman sued the village for allegedly failing to cover a hole her son fell into last year.

Gina Dinardo filed her lawsuit in Will County court.

Dinardo's son, Bobby Cuban, fell into a hole in July 2013, the lawsuit said.

Bobby was "walking lawfully along the side of a public pond near Yamma Ridge" when he fell into a "drainage hole ... that was not reasonably safe," the suit said.

"The hole was supposed to be covered with a plastic cap by the Village of New Lenox for the safety of its residents, but it was not," the lawsuit said, and had been left open for at least a year before Bobby fell into it.

Bobby suffered a "large laceration" to his shin when he fell in the hole, the suit said.
