Board members from New Lenox School District 122 Board of Education continued to do battle Wednesday night, and this time Maureen Broderick was up to bat.
Broderick announced at the regular meeting that Kathy Miller had on Feb. 1 issued her an ultimatum—resign or face a lawsuit.
The controversy stems from a Jan. 11 hearing, objecting to Miller's nomination petition. The notary error on the petition was determined on Jan. 28 to be insufficient to eliminate incumbent Kathy Miller from the New Lenox school board ballot, Will County Judge John Anderson ruled.
Broderick was accused of orchestrating the objection to the petition in such a way that she could sit on the district's Election Board and vote in favor of invalidating Miller's petition.
Miller was unavailable for comment. She was absent from the regular board meeting.
The ultimatum was hand-delivered Feb. 1. Board President Nick DiSandro, on Miller's behalf, delivered the news to Broderick at the district office. DiSandro said he was simply serving in his role as president.
He said Broderick's resignation was discussed as a resolution immediately following Miller's appeal of the original decision to remove her from the ballot. Miller's attorney for the appeal brought up the matter, while still in the courthouse.
What DiSandro described as a resolution, Broderick referred to as a "threat."
"There is no threat," DiSandro said. "I made no threat. If you're upset with anyone, look in the mirror."
On Feb. 19, the first step in the process of civil litigation was filed by Miller's attorney, Michael Foley, who filed a Freedom of Information Act request for all of Broderick's communications, including cell phone, email and any other devices that may have information relating to Miller's hearing.
Also issued FOIA requests was member Sue Smith, who also voted to invalidate Miller's petition, along with Nikki Sanders, who testified as the petition objector at the hearing.
Broderick highlighted portions of Miller's statement after her appeal was overturned. Vindicated by the judgment, Miller previously said: …"my goal is to see that this is the last time our resources are wasted in such a shameful manner," referring the $9,000-plus it cost the taxpayers to process the objection along with the personal expense she incurred in the appeal.
"This waste is still ongoing and hasn't stopped," Broderick said.
She also called Supt. Michael Sass to task for an "attack" made public in a six-page letter read publicly five years ago. The attorney hired by Sass at the time to represent the district in actions aimed at Broderick is now representing Miller in her civil action against her.

Wow..It's hard to think of a comment for all of this. These are the people charged with running a multi-million dollar school budget? We would be better off having the kids of District 122 run the show. At least you could understand the bickering and sniveling then.

Miller is the one responsible for jacking up our property taxes. Broderick and Sue work hard to find ways to save money. Kathy is old and does not have kids in school here so please go away.

WOW, I'm almost at a loss for words. I'm irritated that any Board member would pull such a stunt that has now cost the taxpayers of New Lenox over $9,000. First we have a Board member involved in stalking, but at least she resigned before embarrassing the District further. Now this, when is it going to end? My opinion is Kathy Miller has every right to go after Broderick/Smith/Sanders for their little stunt, which has backfired in their faces. What other recourse does Miller have? This started with Broderick and it needs to finish with Broderick. I will never vote for anyone who has cost me more money, and has an obvious agenda that has nothing to do with the interest of our children. Greg Loock will be on the ballot, and he will get my vote. Just because you hold a seat on a School Board doesn't mean you can get away with acting like a child.

The reason the board has had so many disruptive issues in the last few years is because of Broderick and Broderick alone. She is a mean spitefull person that has an agenda that has nothing to do with the education of kids in this town!

Kathy Miller is a very nice woman and I don't blame her one bit for fighting to clear her name and to put things back right again. Everything in life costs money and there are funds set up in the school budget for this type of an expense. It does not take money away from the children because how a school budget is set up, every dollar must be ear tagged for a specific purpose and that money can not be moved from category to category. If a parent sues the school, the money for the defense does not come out of textbook supply line or transportation budget line - it comes out of the legal expense line item. Also, realize that these are all people, regular humans and it is our nature to fight back when we have been attacked. People tend to forget that these are regular people who VOLUNTEER their time for this. It is amazing that so many people can criticize but not ONE will step up to help or run for the board. If you are not willing to step up and help (run for the board), then you have no place to complain about anything that is going on.

Let me see if I have this:
Broderick tried to get Miller off the ballot over rule violation.
Miller stayed on ballot.
Miller wants Broderick gone because a rule states Broderick wasn't supposed to file complaint AND rule on same complaint.
I'm very thankful I don't have to live with either of these two women. God help their husbands.

Why is a board president the go between for Kathy and Maureen? Shouldn't Kathy's attorney have been the one to have said resign or we'll sue? I don't see where it's the board president's job to get involved in a civil case. Kathy could have avoided this whole mess had she actually done her paperwork correctly! I don't personally know Maureen, but it seems like she is the one who is constantly slandered. Why does Miller think she doesn't have to follow the election laws regarding her petition? Why do they want Maureen gone? Is it because she doesn't go along with every little thing they want to do? Is it because she likes to shine a little sunlight on things like violations of the open meetings act and dividing a former asst. superintendent's salary amongst themselves? Is it because she didn't vote for the dumb math program? Really, all of us who pay the bills would like to know. We would also like all of our employees and board we elected to represent us to act in the best interest of the children and taxpayers. We don't want them acting like animals fighting over the last piece of food. I won't say they are acting like children because even children behave better than this.

As for the board, some people say they would not vote for anyone who would cost them more money, yet whoever sits on the board will make decisions that will cost the taxpayer’s money.
Others question how this effects the children, but it is parents who complain to their children like a 7 years old is their best friend about what is going on that will create the effect.
Still others say the money doesn't come from fund that are used for education, but the simple fact is that most of the money that comes from the state can be allocated anyway the board and Dr. Sass sees fit. If they need a shortage in the operations and maintenance account they just need to allocate less to the fund. Or if they want to give nice raises they just allocate more to the fund that houses teachers’ salaries.
I think that you need people who are not only ex educators and nurses on the board, but who are accountants and financial planners. But good luck with that because no one would want to deal with the political partisanship or the "it’s all about the kids" crew.

Let me see if I understand this correctly. I was at the hearing. A New Lenox resident filed a challenge claiming Miller did not file her petitions correctly. Miller admitted that this was true. She's angry that the board voted against her because she did not follow the rules? Miller clearly knew the rules as she is a current board member. So why is she crying foul? Every other candidate has to follow the rules. She does not? If the rules are bent or changed for her, as they were by the appeals judge, then why do we have rules at all? Millers problems appear to be of her own making. She cost the taxpayers money by fighting it when she knew she was not in compliance. She could have withdrawn and saved the money. She didn't. She's clearly blaming other people and not taking responsibility for her own mistakes. No one has pointed to anything that other board members have done wrong, but are still blaming them? Follow the rules and you will have no problems. Either no exceptions, or no rules at all.
