New Lenox Man Arrested for Child Pornography and Cocaine
A narcotics investigation netted sexually explicit photos of an underage girl.
A New Lenox man is facing two counts of child pornography and manufacture or delivery of cocaine.
Michael McGrath, 22, of the 100 block of Terry Ellen Lane, was busted in what started as a narcotics investigation by New Lenox police, according to a story in the Southtown Star. During a Tuesday search of his home, "sexually explicit photos of an underage girl" from Tinley Park were found on his cell phone, Sgt. Louis Alessandrini said
For more information about McGrath's relationship to the girl, go to the Southtown Star.
According to the Will County Sheriff's Office, McGrath was booked into the county jail at about 1:15 a.m. today. He faces two counts of child pornography, manufacture or delivery of cocaine, possession of a controlled substance and possession of marijuana.
Bond was set at $100,000.

Police blotter information is provided by the New Lenox Police Department. Charges are not evidence of guilt. They are a record of police actions taken on a given day, and persons charged with a crime are presumed innocent until proven guilty in court. If you or a family member are charged or cited and the case is subsequently adjudicated, we encourage you to notify the editor. We will verify and report the outcome. If you have information about an unsolved crime, call the Investigations Unit at 815-462-6100.

What led to the search warrant? Or was it just a random home-search?

Hi Cynthia; I'll ask NLPD tomorrow, but they're usually pretty tight-lipped about that kind of thing. It's an investigation.

Ahhh. Secret police investigations. Sealed indictments. Gag orders. Broad home searches.

I think it's really wrong to post mug shots of people. It's like horrible gossip. How do you think these (accused/not yet convicted people's) parents or grandparents feel when they see their loved ones pictures and stories posted? Don't you think people make mistakes like the DUI's that you always post with pride. Don't you think it's harder to turn their lives around when everyone can see their dirty laundry? I just think its really spiteful and hurtful.

I second Jon's comment. Posting the mugshots presumes that NLPD never makes mistakes or overcharges their perps.

If police actually even had a warrant, they are required to specify the scope. They can't just search a house and phone hoping to find evidence of any crime. If they were looking for drugs, then the other stuff will get tossed by a competent attorney.
Looks like they didn't get the cooperation they wanted, so they are just embarrassing the guy. Actually, they are just embarrassing themselves.
I guess we'll never know as it is a 'secret' investigation. Pesky Bill of Rights.

I thought I read yesterday that the pictures were of his 17 year old girl friend. Does this really constitute "child porn"??

The fact that the parents knew and the fact that the girl is now 17 doesn't really matter. What I'm sure they are going to try and determine is the age of the girl when the pictures were taken."No Name" above mentions it's been a long and serious relationship long as in what 2, 3 maybe 4 years? So this girl could have easily been as young as 14 when these pics were taken. As far as the drugs there must have been some legitimate reason to search for them. Possibly neighbors observing people regularly coming to the house and staying briefly. A pattern of some sort of transactions taking place. At that point law enforcement has every right to check his phone for possible leads to "bigger fish" and deals made by texting or voicemail. The pictures were just a bonus and more than likely by the looks of the individual (appearing underage) prompted that whole thing.

Lastly the Patch is posting arrests Statistics have proven that in areas where there is a high rate of prostitution for example. Publishing the names of individuals arrestedfor soliciting these "ladies" has helped considerably. So the solution is simple. You want to keep your name and picture off the arrest page don't get arrested. If you need to seek the services of a prostitute go to Nevada where it's legal. If you are a man who feels the need to engage in sexual activity with another man. Fine but go to a motel and not the woods on Francis Rd. To all the"chicken little's"yelling "the sky is falling".We are not becoming Nazi Germany with random house to house searches.Get real

He should use the "David Gregory defense" to fight the statutory rape charge. That is, as long as he thinks he has a good reason to do it, it is legally justified.
Alski has good point, but the laws are now so complex and numerous that we prolly all break 10 laws a day without knowing. Read about Gibson guitar's troubles for an example.

YOU PEOPLE ARE IDIOTS...CLEARLY THIS PERSON HAS VIOLATED THE LAW. THESE FACTS ARE PUBLIC RECORDS, THE SAME AS IF ANY OF YOU GET A SPEEDING TICKET, DUI, OR BREAK THE LAW AND GET CAUGHT, THE INFORMATION GOES ON A BLOTTER WHICH IS PUBLIC. SO IF ANY OF YOU GET A DUI ARE YOU GOING TO CRY BECAUSE YOUR NEIGHBORS NOW KNOW. GET A LIFE...HE WAS DISTRIBUTING COCAINE AND HAD A UNDERAGE "GIRLFRIEND". HE SHOULD BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW....AND MAYBE THE ONES SUPPORTING SHOULD BE INVESTIGATED ALSO.

NO NAME, YOUR OBVIOUSLY BIASED. YOU PROBABLY SHOULD QUIT POSTING.........BEGGING. IF YOUR CHILD OVERDOSED AND DIED DUE TO HIS DOPE SALES WOULD YOU FEEL THE SAME WAY? IF IT WAS YOUR JUVENILE DAUGHTER POSTING NAKED PICS WOULD YOU FEEL THE SAME WAY? HE KNEW DRUGS WERE ILLEGAL TO POSSESS AND OR DISTRIBUTE, SO NOW HE MUST PAY THE CONSEQUENCES AS EVERYBODY ELSE. OF COURSE THIS IS BASED ON THE FACTS, BUT IF IT IS TRUE I HAVE NO, NONE NADA, ANY SYMPATHY FOR THIS MAN FOR WHAT HE HAS DONE. IM TWICE HIS AGE AND NEVER HAD A "LONG TERM RELATIONSHIP" WITH A MINOR! NOR HAVE I SOLD BOUGHT OR USED ANY DRUGS. I WORK, PAY MY TAXES, AND RAISE MY KIDS IN HOPES THAT DIRT BAGS LIKE THIS, IF GUILTY, GO TO JAIL AND IM HAPPY ABOUT IT. THE REST OF YOU PEOPLE LIKE CYNTHIA AND JON, NOT TO BE RUDE BUT WAKE UP AND GET OUT OF YOUR HALLUCINATION. YOU NEED TO BECOME EDUCATED ON THE LAWS OF THE STATE YOU LIVE IN! THIS IS THE REAL WORLD AND THERE ARE BAD PEOPLE IN IT! THINK ABOUT THIS, HE IS 22, AN ADULT, DATING A 17 YEAR OLD. IS HE DATING HER TO REACH THE TEENAGE CROWD FOR HIS DRUG SALES? AS A POLICE OFFICER FOR 22 YEARS IVE LEARNED THAT DEALERS ONLY CARE ABOUT THE MONEY, AND ARE OPPORTUNISTS AND LIARS. I DONT CARE IF ITS HIS FIRST ARREST OR NOT, IF HE IS GUILTY HE NEEDS TO PAY FOR HIS MISTAKE! NO FREE RIDES....THAT IS WHAT IS WRONG WITH AMERICA THESE DAYS IN MY OPINION.

So, either you are impersonating a police officer on a public forum, which is really stupid, or...
You actually are an NLPD officer, which is even more frightening. You can't even have a normal discussion without going apeshit. You are representing your entire department with your psychotic rants. You have authority and a gun, yet zero self-control. You give the entire dept. a bad name. Find a new career as it looks like you are burnt-out.

I don't condone cocaine use or dealing. I don't condone 20 year-olds dating 15 yo kids. There are laws and consequences to discourage this.
I also don't condone secret investigations and violation of due process. There are also laws to discourage this, but officer clutch finds the laws inconvenient. It's easier to catch criminals if police violate these laws, but the evidence gets thrown-out on technicalities. If you break the law trying to catch a criminal, you are no better than them.
So, if police are serious about upholding the law- uphold ALL the laws- don't pick and choose which apply to any given situation.
more:
Warrants are supposed to narrowly tailor the scope of the executing officer’s authorized search. Courts enforce this requirement strictly.
The State Bears the Burden of Proving that the Warrant Applies
Search Must be Within the Scope of the Terms of the Warrant and be Supported by Probable Cause
Officer’s Intentions Irrelevant so long as the Search Does not Exceed the Scope of the Warrant

JED HOW AM FINDING LAWS INCONVENIENT? I LIVE BY THE LAWS. WHERE ARE YOU GETTING SECRET INVESTIGATION FROM? THE REPORTER? THERE WAS A SEARCH WARRANT, WHICH HAD TO BE GIVEN AND CLEARED THROUGH A JUDGE. THERE WAS NO VIOLATION OF DUE PROCESS, IFF YOU EVEN UNDERSTAND WHAT THAT IS. WHAT LAWS WERE BROKEN BY THE POLICE? YOU ARE CLUELESS JED AND PROBABLY THE WORST ONE BECAUSE YOU THINK YOU KNOW WHAT YOUR TALKING ABOUT BUT YOUR IGNORANT. Look up ignorant in the dictionary Jed. THE NLPD DID THEIR JOBS! JED DO YOU KNOW WHAT THE SEARCH WARRANT AND ITS "SCOPE" WAS OR ARE YOU JUST REITERATING CALVINS RESPONSE? ARE YOU A DEFENSE ATTORNEY? IF NOT YOU MISSED YOUR CALLING.............MINUS AT LEAST THE PROPER EDUCATION FOR IT! IM DONE, GOODBYE. YOU JUST CANT FIX STUPID!

Why does everyone assume the girl is 17? Because someone wrote she thought she read it in yesterday's paper? You can't be serious. No one knows any of the detailed circumstances yet so many are sure of their position on the issue. Age of consent is a red herring. Check the Illionos criminal code. The age disparity is what is most important according to the law. Also, child pornography is age determinative. 15, 16, 17 years old is a child according to statute. Whether he is a good guy doesn't really matter. He may be great to his friends and family but this is not relevant to his arrest. BTW, inadvertant discovery of evidence of any crime during a legal search is clearly admissible in court. Case law on this matter is definitive.

We can go on and on debating particulars, which does not reduce the fact that he broke the law, and he still has to pay the price for his decision...It doesn't matter what he has been through or was going through. If it was that important why didn't anybody step up and help solve the problem....because nobody wants to get involved but have a lot to say on what should have happened. That's what's wrong with our communities now...nobody want to move unless something bad happens, instead of before something bad happens. So pass me with the sob story. Community leaders need to step up and until that happens...we will keep reading stories like this and having meaningless conversations

The way you keep responding makes me think that (1) you know this pedophile, (2) he's related to you, or (3) you just get off on supporting criminal. If I'm wrong on the age so be it...it still does not hide the fact that he is a CRIMINAL....CRIMINAL GO TO JAIL WHEN CAPTURED. So relax with your legal lesson....It was morally wrong if its is not legally wrong....to be involved with that "child" she was under 21. If you don't see a problem with that I hope you don't have kids. Let not forget that if she was with him and around she was exposed to ILLEGAL DRUGS (CRIME), whether by consent or not....there was a crime committed and how many others were exposed. Maybe it just me but I wouldn't my kids exposed to this slug.

Fact is, none of us know the whole story. We've all read these police blotters and seen how the cops will stop some kid with 3 grams of weed and suddenly it's a felony and they splash the booking photo, which gets picked-up all over the internet. Nobody will hire them when they google the name- and companies most definitely do search for potential problems.
Then silently, a few weeks later, the charges are significantly reduced or dropped all together. The problem is the original charge is in the search engine and the person is left to suffer for the original trumped-up charge.
It's like that kid in Mokena who drove his OD'ing friend to Silver Cross and got pulled-over. Cops charged him and everyone thought he was a junkie. Charges were later dropped, but nobody hears about that.
Patch prints the unsubstantiated charges because it gets page-views. Sleazy, really.

The things that the taxpaying citizens should REALLY get upset about is:
Will County Family Court Justice Polito, age 69, who in 5 days visited 243 porn sites on his work computer. Sites like teensextapes.com (sounds like child porn) and the court handled it with am internal investigation. He was suspended for 60 days, but will retain his job and pension. Unacceptable.
http://newlenox.patch.com/articles/60-day-suspension-for-will-county-judge-who-viewed-porn-at-work-23026008
Will County Sheriff on Laraway 'lost' 8.8 POUNDS(originally) of pure heroin from outside lock-up. Sheriff Kaupas’ daughter, Jana Schaeffer was responsible for the loss. No one was fired or lost their pension. 40,000 hits of heroin back on our streets with no repercussions mentioned. Stern reprimand, maybe?

Good move Ann. Sometimes it really gets heated here!! One final comment if I may. It is true and there is a case where a 16yr. old female sent nude pictures of herself to her 16yr. old boyfriend via text. An adult discovered the pics and reported it to authorities. She was ( and within all rights of the law ) arrested for production and distribution of " child pornography " because the pictures were of a minor. Despite the fact they were of herself. Taken by her and sent electronically by her and intended for her boyfriend only does not make it LEGAL. This is why young people need to think long and hard about the decisions they make and the roads they choose to lead their lives down.

Who cares about the child porn charge! This guy a drug dealer who is supplying the 16-year old and her friends with cocaine, MDMA, marijuana, Xanax, and he should be put in jail for it. He is responsible for introducing addictive substances to very impressionable younsters. These kids are going to turn to the harder drugs, like Heroin, contributing to the rise in use of Heroin in the Southwest Suburbs. Not only that, he is probably dating a high school girl, for the sole purpose of securing the market for his drug sales. Come on, porn charge aside, this guy is sick in other ways.
