Frankfort Doc Accused of Groping Women Faces New Lawsuit

A Frankfort pediatrician accused by five women of sexually abusing them in his office has been sued by a sixth woman making startlingly similar claims.

 

A Frankfort pediatrician acquitted of charges he groped a Joliet woman in his office more than 10 years ago has been smacked with a lawsuit alleging he pulled the same stunt on another woman in 2011.

The lawsuit claims Dr. Kishor Jain touched the mother of one of his patients "in a sexual fashion" and caused the woman "shock and horror."

The woman had taken her child to Jain's office in the Hedges Clinic in August 2011 when he suddenly "grabbed (her) breasts with both of his hands while she was talking to him about her child."

Jain said he remembers the woman, identified in the lawsuit as Jessica Schubbe, 29, of Manteno, but denies ever molesting her.

"The accusation is completely false," Jain said. "The person has other problems and she's using this as an excuse. It's very sad it's come to this, but it's absolutely untrue."

Jain also said it was untrue when a then 21-year-old Joliet woman told the Frankfort police that Jain groped her breasts and rubbed her thighs and between her legs in December 2001. He also allegedly tried to unzip her pants.

The woman had been a patient of Jain's when she was a girl, police said.

The woman, Brenda Doyle, had taken her 9-month-old son to Jain for a checkup, but the doctor quickly turned the conversation to the woman's sex life, how often she has sex, whether she enjoys it and if she watches "dirty movies," according to a police report.

Jain later explained to a Frankfort detective that Doyle started the sex talk when she told him she "does not feel any sensation in her breasts," a police report said.

The report went on to say Jain told the detective that Doyle informed him "she is not currently on any contraceptive and has not been sexually active for several months. She had a lack of interest and satisfaction with it and it didn't stimulate her."

And that was supposedly why Jain examined her breasts, back and abdomen. In the report, Jain said Doyle "did not display any discomfort" and that the "examination was very brief and was intended to help Brenda with her problem."

Jain was arrested in January 2002 on misdemeanor battery charges stemming from his alleged assault on Doyle. The case was handed off to the Illinois Attorney General's Office after it was determined a staffer in the Will County State's Attorney's office had a relative who had been treated by a physician at the Hedges Clinic.

Jain was found not guilty. The case was later expunged.

After Jain's arrest, another Joliet woman contacted the Frankfort police and told them a nearly identical story. The woman, Adrianna Pena, then 23, told police she had taken her son to Dr. Jain for a checkup in 1999.

When the checkup was finished, Jain told Pena to get on a scale so he could check her weight, according to a police report.

"After I weighed myself I got off the scale and he touched my chest and my behind and after that I moved right away," Pena told police.

Pena said her mother called the clinic to complain. A nurse said she would call her back but never did. Pena then went to a Joliet lawyer about suing Jain. The lawyer "told Pena that a civil suit was not his area of specialty and if he referred the case to someone it would end up being the doctor's word against hers," a police report said.

"Pena was still very upset at what had happened to her but was concerned that nobody would believe her so she did not pursue the matter," the report said.

Seven years before that, an Orland Hills woman told the Frankfort police Jain quizzed her on her sex life, fondled her genitals and penetrated her with his finger. He also fondled her breasts, the woman said.

The Orland Hills woman, Sharri Szelag, was 23 at the time. She went to Jain to be treated for abdominal pain and bloating.

In 2002, two more women, Robin Mendoza and Kerry Tadej, sued Jain. Mendoza and Tadej claimed Jain "fondled  and touched (their) breasts and vagina."

The lawsuit says Mendoza took her son to see Jain in January 2001 and that Tadej was treated by the doctor in October 2001. Records show the case was settled out of court in May 2007.

Jain was sued two other times, in 1982 and 1990, but the court files are not available in the circuit clerk's office and the nature of the suits was not known.

The state's attorney's office passed yet another criminal investigation of Jain off to a special prosecutor in 2011. Once again, the special prosecutor was brought in after it was determined a staffer at the state's attorney's office patronized the Hedges Clinic.

The special prosecutor's office identified the investigation as a criminal sexual abuse case.

Frankfort Deputy Police Chief Kevin Keegan said his department took a report about an alleged instance of criminal sexual abuse on Aug. 19, 2011—one day after Schubbe claimed Jain molested her—and that the matter was investigated.

Keegan says the case remains open and that his detectives are still waiting to hear back from the special prosecutor.

"The ball's in their court," Keegan said.

Staff at the Special Prosecution Unit of the Illinois State's Attorneys Appellate Prosecutor's office said special prosecutor Charles Colburn was handling the case and that a request for comment would be forwarded to him. Colburn has yet to respond.

According to the Illinois Department of Financial and Professional Regulation, Jain has not been disciplined at all in the last five years.

I've gone to dr. Jain as a child and take my daughter to him and he has never once made me feel uncomfortable. I also know plenty of mothers who take their kids to him and have never had any complaints. These women are just looking for money!

My kids have both seen Jain since birth, they are now 13 and 15...he has NEVER made any of us feel uncomfortable. He has been a great doctor to them!

My kids were under Dr. Jain's care in the late 80's but we dumped him for the best pediatrician ever in the area, Dr. William Klipfel. Never had a problem like these women. My question is; why are grown women (all over 21) being examined by a pediatrician in the first place?!

omg! I received a call today that my baby's well visit with Dr. Jain had been canceled. Hedges wouldn't say why. I googled and found this article. All I can think is for goodness sake, my last pediatrician was Dr. William Klipfel. He had a lawsuit against him for locking his adopted son in the bathroom everyday without food or supervision. I think a background check is in order for my next doctor.

Why aren't these woman going to a gyne. for female problems. I have taken my 3 kids, 2 girls, to him since early 80's. My daughter now goes to him with 4 kids. Never once has he exhibited anything out of the norm. with either of our families. What is this world coming to??

Dr. Jain is THE BEST doctor at Hedges in my opinion. I can't even tell you how long we've been using him. It just totally sickens me that these people would tarnish this wonderful man's name and profession just to make a buck. Just so that you all know, I never even finished reading this article because it just made me sick. I will call hedges tomorrow and tell them that if he needs any support or letters of character, that I will be MORE than happy to help, and I'm sure that my grown boys will, too. I just recently saw him for an ear problem that I have been dealing with. Me, a grown woman saw him because HE IS A GOOD DOCTOR AND HAS COMPASSION FOR HIS PATIENTS! He is NOT a monster! And yes, I am yelling because reading this JUST PISSES ME OFF! I told Dr. Jain years ago that he is the only reason that I keep going back to Hedges (with my kids). That's it, I'm done.... for now.

Dr. Jain is the best doctor at Hedges Clinic, Silver Cross and St joes. We have been going to him for over 26 years. Never ever made any of us uncomfortable. This article is absolutely horrible. I also will write a letter to all 3 facilities on how wonderful he is. Very excellent and passionate Doctor.

My son has seen Dr. Jain as well for many years and I have NEVER once felt uncomfortable by him. He is a very compassionate, thorough doctor. I agree with Cindy....why are these grown women talking/seeing a pediatrician about their issues?

Dr Jain is one the most compassionate Drs I have had the pleasure of knowing, his way with children will never be matched,,,,I worked at Hedges for 23 yrs. From the first day that i started there he has always been a Gentleman. The thousands of patients and their parents have never came out of his rooms complaining about him. If I had thougt in my wildest dreams that he would ever do such a thing I would have never let my grandchildren to ever step into his office....I find this very hurtful to a wonderful devoted DR....

I'm in my 30's and still see dr Jain as my primary care doctor. I make back to back appointments for myself and my son! He always makes me comfortable and knows my family history well since he also sees my siblings and their children. He has shown nothing but care and compassion for me as well as my family. We fully support him!

Dr. Jain takes the time to listen to you AND your kid. Even if he is on his way out, thinking that he has completed his visit, if you start to ask him something else, he will not only hear you out, but he will come back into the room and sit down to he is sure you have no more questions or concerns. He is wonderful!

I believe in innocent until proven guilty. I also believe that same courtesy belongs to the accusers. Just because a lot of people here, and even I, have never had a problem with Dr. Jain does not mean that it's not possible that others have. I'll personally withhold my judgement on either parties until a complete investigation has been done and all the facts are presented. What makes me sad is that some have already decided that the women involved are just out to make a buck. The prejudgment of them is, I believe, why a lot of women don't come forward when something inappropriate actually does happen, and that is a shame.

We have been patients of Dr. Jain's for over 20 years and never experienced anything but professional behavior. Jill's and other's positive comments are dead-on. Unfortunately there is a lot of prejudice in this world and this could fall under that. It could also be that these women made inappropriate advances and were rejected, so they are trying to get even. I find the accusations hard to swallow. I truly believe there is an ulterior motive.

I have worked in the medical field for over 25 years, working with many different physicians in the area. I chose Dr. Jain as my children's pediatrician because of his outstanding reputation. He has not disappointed us throughout the past 16 years. As any parent, I have always accompanied my children into the examining room. Not once has he ever came across as remotely inappropriate. My observation is that he is extremely thorough and takes his time with each and every patient. He asks questions and treats each patient as an individual,not only physically but on a personal level. Unfortunately I find this to be rare in this day and age of healthcare. It saddens me that, at least in the first case, a woman turned to him for help/advice and she turned the events around on him and used it against him when he examined her. If you complain of breast issues expect to be examined in that area! Same with the groin or genital area.

A PEDIATRICIAN should NOT be assuming he knows enough about gynecology to treat ANY ADULT woman.That he would assume he could perform in that specialty arena realm certainly raises a red flag! So, does he perform pap smears as well?? Yeah, right!

My son is a patient of Dr. Jain's as well and was treated by him just last month. He is compassionate, thorough, professional and of excellent demeanor.
Myself, I'm a risk manager and find these accusations troubling to say the least.
However, I also found the headline to be over the top as well. To Patch I say cut the crap headlines, discuss same amongst your editors before putting it out in print. If you strive to be a professional news source, then write that way.
To my sons good doctor and the clinic, I suggest a thorough review of your patient practices. As mentioned, why is a 23 year old seeing a pediatrician? I know folks have loyalty as do I, but perhaps there should be a clinic policy of at the age of 18 or 21 you are referred to a physician who treats adults.
Although the Clinics exam rooms are small, I suggest a nurse be present during consults or exams. Finally, like it or not, there is the ever popular insurance lottery and often it is best to settle than have protracted court fight. News travels fast about targets for a quick payout and some folks are quite adept at cashing in. Good doctor, refer such patients with complaints outside of your specialty. Finally, if there was compelling evidence, the special investigations would have proceeded. Perhaps the SI people are suspect of the accuser????
My son has been treated by the good doctor for 15 years and as long as he wants to be treated by him its perfectly fine with me.

Sadly, a lot of the responses to this article are the reasons why many victims of sexual assault, abuse, etc. don't come forward. Many automatically blame the victim or simply don't believe them. Just because it hasn't happened to YOU didn't mean it didn't happen to them. Predators choose their victims carefully, so please be careful before you cast any stones against the accusers. And it seems to me that with so many complaints against him, especially considering that he's settled at least one, doesn't exactly instill confidence in his character or innocence.

Dr. Jain is innocent until proven guilty..and at this point i'm stand behind him! He has been seeing my children for 6 years now and has never made us feel uncomfortable in any way. He is very thorough doctor and I trust him medically with my children..In my opinion he is a doctor who truly cares about his patients.

Any one is capable of doing anything..Guilty until proven innocent..But you can not just say the accusers are lying just because you know or use him...Every person that has done something to someone is someone's son,daughter,cousin,friend..but that does not mean they did not do what they are being accused of...

Comes on here...I did mean to say guilty until proven innocent ..because that's how it works..We can say it is the other way around but it does not work like that..Why are you arrested before any evidence is found and only accusations exist? Why do you have to give money before you get out if your not guilty? why are you detained and housed before you are found guilty?... We can say water runs up hill and hot is cold and cold is hotels we want but that's not how it works...now is it?

I see a lot of women making comments that this doctor could not do what they are accusing him of but from my experience where there is smoke there is fire. I find it very difficult to believe that all these different women could be making up stories that sound very similar. I have seen way too many instances where doctors have been able to hide behind their degrees.Most attorneys will try to talk them out of suing,they will tell you its your word against his and who will they believe? I realize our courts are backed up with frivolous lawsuits but there is no excuse for our legal system not to prosecute these people. How can we as a society allow someone like this to practice medicine around anyone,let alone children. Many of these women who are sticking up for this guy need to think how they would feel if the tables were turned and no one believed them. They may be absolutely correct,he may have been completely professional with them but I did notice one similarity in all the women who complained about this ,they were all in their early to mid 20's. These guys sees many women every day and it is possible he has a specific type he is attracted to. If he abuses even one person he has no business practicing medicine anywhere. This is a sad statement on the our legal system,it sounds like they are afraid to go after this guy and are passing the buck. I can only hope that someone at the special prosecutors office get a backbone and goes after anyone that mistreats patients.

We shouldn't make thee accusers out to be money grabbing idiots. If this is true they have experienced an enormous amount of self doubt and denial already. They don't need it coming from the peanut gallery. The "if" will be argued in court.

I agree with you 100%. I find it interesting that this is being tried in the court of public opinion on this site. There is a reason we have police departments, investigators within those departments, and a state attorney's office. How would all these posters feel it they or their child was the victim and the people of the LW Way decided to put them on trial on the Patch's website? This is why bad guys get away with stuff. People don't want to be victimized a second time by not being believed by people who don't even matter anyway. Why is a pediatrician treating adults anyway? Hedges has doctors for adults. There is no such thing as a one size doctor fits all. His license with the state of IL clearly states pediatrics. Let the states attorney and the courts do their job, that's why we have them.

Why on God's green Earth is Patch printing the name of these victims? Editor Ann- your judgement is very suspect and I imagine Patch will see some lawsuits on this one.

I've taken my kids to see Dr. Jain and had no complaints. Sounds like the targets are all early 20's girls, so there does appear to be a pattern. Just because he never made a pass at you doesn't mean it didn't happen. The problem I have is trying the guy in the 'news'. Names should be sealed pending investigation.

Don't worry- he'll just retire and add to the shortage of good doctors.

Doc admitted to examining Doyle, which is cause for alarm since Doyle was in the doc's office with her 9 month old son. The guy is a pediatrician, not an OB/GYN. I'm surprised the 2001 case was a bust (no pun intended).

I went with my girlfriend years ago to get Davey's check up we told the Dr. that he rolls
over already, he said that's impossible. He had us stand outside the room, he left the room, Davey rolled off the examining table. We yelled at Jain's and said why did you do that we told you he rolls over. It was a week later Davey died. I was also told that Doctor's need special something...permit..training...in order to give
allergy shots, Dr. Jain's did not have that qualification to do so.

First of all molestation is about boundary violation. A predator works on breaking down a child's boundaries little by little, over time. So much so that the child does not recognize when the inappropriate behavior occurs and then keeps occurring until it is obvious to others. Often the children do not recognize the boundary violation when they are adults. Second, why didn't the physician change his treatment policy after the first accusation (stop treating those over 18, stop treating certain symptoms, or always have a nurse in room) or at least after the second accusation? Third the lack of professional boundaries by this physician is extremely concerning? Why didn't he halt these conversations with these women and refer them to a more appropriate physician or the very least pull a nurse in the room with him to witness what was happening? He was in he position of power with these patients, and did neither to protect them or himself.

Dr. Jain is one of the few caring doctors left in this world. The truth will prevail. Maybe Dr. Jain could sue them for slander.

Furthermore, the lawsuit was settled for pennies. Just another get rich scheme.

I'm 42 years old & I have been a patient of Dr. Jain's since I was 9 years old. My daughter is 25 years old & has been a patient of his since she was born. My granddaughter is 8 years old & has been a patient of his since she was born as well. My older sister & her 2 daughters have been patients of Dr. Jain for decades. I have friends who have been his patients as well as their children. NONE OF US HAVE EVER EXPERIENCED AN INAPPROPRIATE BEHAVIOR FROM DR. JAIN!!! I was born with an extremely rare hereditary disease (Wilson's Disease) and that is why Dr. Jain is still my primary care physician even though he is a pediatrician. Dr. Jain has been nothing but caring & professional with me. I'm sure anyone who knows Dr. Jain would find these accusations extremely hard to believe!

Wow i love how all the people defending the doctor most likely leaves their children in a room with them. Thats just bad parenting. If a person, no matter if he is a doctor, is accused of inappropriate contact with a person, no matter the age, he should not be left alone with a child, EVER. I have my thoughts on this subject AND this doctor but i wont post because its no ones buisness. Just watch what you say, imagine if your daughter felt uncomfortable around someone, rather they touched her or not, and see what you have to say about it then. No one cares if you would spend every dime you have proving this man is innocent. Don't assume people! It makes you look unintelligent and naive.

I've known Jessica since we were only 12 years old, when she herself was being seen by Dr. Jain, and I can tell you that the shame exists when a man takes advantage of a woman and because the media chooses to exploit the situation, her credibility is challenged by individuals who don't know the slightest thing about her.

She did not opt to have her information printed. It was not her choice. That was courtesy of the media. So to say that "it is a shame what people will do for 15 minutes of fame" is absurd. She's merely trying to keep other women from being violated by a man in whom the public has established trust.

Like some of you, Jessica trusted this man to care for her children's medical needs. Unfortunately, he took it upon himself to cross the ethical boundaries that are set forth for ANY individual.

Being sexually violated can be devastating enough, especially when violated by a man that you have trusted. Facing that man can be even more devastating, especially when it's someone well known and respected. Not only because of the intimidation factor, but also because of the persecution faced by uniformed members of the public.

It's a shame that some people are so quick to pass judgement on a victim rather than taking the time to fully understand the situation.

WHEN this case goes to trial, I too will be there, but to support Jessica Schubbe, and to take a stand against the sexual predators that are camouflaged throughout our society.

Like Maureen I worked at Hedges for many years. Dr. Jain never was inappropriate with any one as far as we knew. Never did anyone ever come out complaining they were taken advantage. My granddaughter (father in military) was in town visiting when she came down with a bad urinary tract infection. Dr Jain did his best to accommodate her and my daughter in law, gave the best medical advise then any of the previous doctors she had seen. He has always had a heart of good will. Patients care is all this doctor lived for. So this article upset me very much. I feel to much detail was used...is this not what causes "copy cats" to feed off on? Dr Jain, I will always respect the care giver you are.

First of all, this article is overly descriptive and distasteful. Shame on you The Patch for being very unprofessional and juveinile regarding the content and title of this article (I'm aware that you changed it but it's still showing in google).
I have been seeing Dr Jain for 26+ years now, starting as my peditrician. Like most of the other comments on here, I have nothing but good things to say about this physician. He's an amazing, care and attentive doctor and still I wouldn't hesitate to recommend him to anyone and everyone.

We will never know the answer. No one seems to want to answer. I just find it bizarre. I would love to know if insurance is covering adults to see a pediatrician, which is costing insurance companies and of course everyone that has insurance a bundle.

Dr. Jain is not just a Pediatrican. My children have bad asthma and allergies. People stick with the doctor that knows their history and truly cares about them. He has been their doctor for over 26 years. Hope that answers you question.

I too worked at Hedges for several years and our children saw Dr. Jain, and when our daughter was in college she saw him for severe back pain, and later I took our grandson to him. He is a true gentleman, and I pray that all of this is going to prove to be untrue.

I have been going to Dr. Jane for the last 20 years he is an excellent doctor and I would say nothing more than the best about him. I also choose him to be my son's pediatrician, and I would never put my son in he wrong hands. I truly feel sorry for Dr. Jain his kindness has come back to bite him, which is what's wrong in the world today. These women should be ashamed for lying and will be judged on a higher level when the time comes.

Just because it didn't happen to you or your family doesn't mean it didn't happen at all. Predators choose their prey wisely. With that being said, though, Dr. Jain deserves to have the facts explored by trained professionals and not a community message board. It's easy to sit at your computer and judge,no matter what side you're on. (I'd also like to know where "Kris"got the info on Dr. Klipfel. Can't seem to verify that or even find any info on the subject). But bottom line, be careful who you trust, especially with your innocent children.

I'm not sure about you, but I have a great doctor and I have never, ever planned on seeing another doctor. Facing any medical issue can be scary, and medical professionals don't always leave us feeling reassured. Not my doctor. I trust his decision 100%, and he lets me ask enough questions and express enough fears to get to that 100%. I have been seeing him since he first came to my family practice office, and cannot fathom having to see another doctor there because they just don't have the excellent bedside manners that my doctor has. Nevermind that his specialty includes pediatrics, he's also a damn good allergist. Oh, and he happens to be Dr. Jain ;D

Yes it's only been about 6 women 6 different times, no reason he should not be able to continue to see patients. With all the patients he has that is probably less than 1% of his office visits that end up with odd sexual fondling. I get liking your doctor, I understand wanting to believe there is no way he could have done this stuff, but when you see this many people come forward it is beyond me how you can not only turn a blind eye, but go so far as to try and REINSTATE HIS LICENSE! If thats not a spit in the face to all these women then I don't know what is.

I really dont think that this has been investigated fully... starting with the fact that these girls might all know each other and have told one another to go see him and then start this up so that it can look like it actually happened... u never know... i bet that wasnt looked at... and probably should have been... i too think its all about money sorry... he is a great doctor and its a shame that this happened to him. Oh... and by the way hes not just a pediatrician he has adult patients too... alot of doctors do so some of these posts are from idiots!!!

Ever since I read this about Dr. Jain makes me sick to my stomach! My family has been going to him for ages. He was my doctor as well as my sibilings. When I started a family of my own, he was my first pick for their doctor because I know they would be in the best of hands. I can remember being pregnant and calling Hedges to make an appt with Dr. Jain for my carpal tunnel and Dr. Jain see me on the same day because I was in so much pain. Needless to say, he gave me two braces to support my hands and wrist and help get rid of the discomfort I was feeling. Not only this, but can think of the time before I had insurance and he didn't turn me away because of it, but helped me get better, or the time I ended up the emergency room with breathing issues and Dr. Jain called me a week later to see if I was okay and how I was feeling because my levels were heart attack low. How many can you say that you've had a doctor care for a patient like Dr. Jain has? This is just some of the things he did. I can only pray that he is found innocent! I don't want my children to see another doctor, but only Dr. Jain. My family and I are devasted over these allegations being said against him. He is a great doctor and when he gets his license back, my children and I will continue to see him! Dr. Jain if you're reading this, hang in there, you know there are so many who truly know you and know that you're not capable of being this person!

I'm not worried because the truth shall set you free. He was found not guilty before and he will be found not guilty again. He doesn't need to testify on his own behalf, considering this is all about getting paid and his hard earned money just giving away to women making accusations that he touched them in appropriately! This was the case 10 years ago and now. If these women were traumatized by him, they would've come forward sooner like when it happened by telling the clinic administrator. I don't mean to sound heartless toward the alleged victims, but its rare you find a dr. as wonderful dr. Jain. As soon as he pays these so called victims off he will be back in business. He had over 100 letters written on his behalf that a lot of his clients are on his side! What does this say? He's in court today and tomorrow, so we shall see! GO DR. JAIN!! We all got your back!!
