D122 Board Chastises Members Broderick, Smith at Packed Meeting

NLSD122 board members attacked the legitimacy of a Jan. 11 hearing that resulted in removing incumbent Kathy Miller from the April ballot.

 

Since New Lenox School District 122 Board incumbent, Kathleen Miller, was kicked off the April ballot by a 2-1 vote of the Electoral Board that found her petition faulty due to a notary error, tempers have flared.

Seated Wednesday night before a packed room at the Haven Administration Center, Board President Nick DiSandro chastised the actions of Secretary Maureen Broderick for actions he deemed unprofessional. At a press conference Tuesday, he referred to her actions as "dirty" politics on a non-partisan board in an effort to remove Miller from the ballot.

At the press conference, he revealed that he had asked the Will County State's Attorney's Office to look into the matter and notified the Illinois State Board of Education as well as the Will County Regional Superintendent's Office.  

The objection to Miller's petition was taken Jan. 11 before the District's Electoral Board, comprised of DiSandro, Vice President Sue Smith and Broderick. DiSandro was the only one to support Miller.

She didn't get a fair hearing on the objection against her petition, he said. At the hearing, the school district's attorney cited case law that pointed to similar objections citing clerical errors that ultimately got tossed out and the petitions stood.  

He reiterated much of what he said in a Tuesday press conference at the administration center. Broderick reviewed the petitions of those who filed for the April 2013 school board election and filed objections to the documents turned in by Miller and Thomas Hottinger. 

"She wrote both statements but she did not sign (the one against Miller)," DiSandro said.

At the school board meeting, he further revealed that teachers from the district have made him aware that Broderick had sought a copy of an email that went out from union president Katie Kollross referencing Miller's hearing.

Then one-by-one, with the exception of Broderick and Smith, board members expressed their disappointment over the way the hearing and the events surrounding it have played out. Board members Debbie Kedzior, Bill Pender, Miller and Patrick Martino united in chastising Broderick. Kedzior said she was embarrassed by the board's actions this week.

Miller, who announced that she had filed an appeal Wednesday with the Will County Circuit Court, said she was "overwhelmed by the support" of the community, family and friends after her uncontested seat for a two-year term on the board was jeopardized.

Broderick's response to the allegations was "I didn't," eliciting an audible groan from the crowd.

Smith's response to allegations that she too acted unprofessionally was short. "First off I did nothing unprofessional. I rendered my decision based on compliance."

Public comments at the meeting

Suzanne Koehmstedt, a teacher at Liberty Junior High School, parent and taxpayer, read a prepared statement. In it she said: "I'm concerned about the money spent on legal services regarding issues with the board. I would like to know if it's public knowledge how much we've spent in the past nine years. Many of the legalities seem to be for petty reasons which bring no real change to the situation, but bring much negative attention to our District."

She went on to question the expenses of the Jan. 11 hearing, including the fees for delivery of a summons and lawyers' fees.

"Consider what you use the board attorney for. If it's not necessary, use the money for the kids. Make this one of your budget cuts."

Jenifer Zimmerman, communications coordinator for the district, read aloud a written statement sent to the district, discussing what was characterized as "unprofessional" behavior and urging the board as a whole to move forward for the best interest of the community. The letter writer also noted that Miller's removal from the ballot would leave the district open to a possible unknown entity, a write-in candidate with no experience on the board.  

Union President Katie Kollross also publically thanked DiSandro and District administrators for statements taken to stifle the kind of actions that brought the election to a boiling point.

As usual, this board is great for demonizing the person doing their job while protecting the wrong doer! Had Kathy Miller paid more attention to the REQUIRED paperwork and what was necessary as part of the process and/or had she gotten a lot more signatures, none of this would be happening. As usual pettiness and politics take the place of doing what they should be doing for the betterment of the children. Great job board!

I don't think many are questioning the incorrect way that Miller handled her paperwork, she should definitely have been more careful. However, I think what most people are upset about is the way that it was discovered and handled, particularly by Ms. Broderick.

One has to wonder if it concerns Mrs.Koehmstedt the salary increases teachers are given in their final year of teaching. One such increase her own husband enjoyed in this district. In 2005 he was being paid $91,334 per year and then in his final year before retirement in 2006 his salary was bumped to $109,491 per year. That is an increase of $18,157 that we the taxpayers are responsible for paying. That is quite a raise and one that some refer to as salary spiking. Anyone can look at the salaries of 122 employees and see other teachers have enjoyed raises such as this in their final year of teaching.
As a taxpayer this board has more important business than fighting over a candidate's paperwork that was filled out incorrectly. There are no do overs in real life. Her paperwork was incorrect and there are election laws that need to be followed. Why are we demonizing 2 board members who did their jobs?

I so agree with you NLMom, and that spike will also cost the public 20% more every year of his retirement so it isn't just $18,157 it could be easily more than $250,000 over his retirement.

If you researched your homework thoroughly, you would see that I taught in the New Lenox School District for 36 straight years, 29 of which I served as the athletic director for all schools. In addition, I coached basketball and track, all of which played into the salary I received. This information is also public record. How does the information you wrote about me play into what transpired at the meeting last night?

Hey New Lenox Mom - get a clue! These things happen all the time. You're correct in complaining that more care should have been taken regarding the paperwork. But the shady side of politics today is obvious when an elected official goes out of her way to make a mountain out of a molehill for personal or (obviously) political motivation. Government can't be effective when it is bogged down with minutia like this. We see this at the state and federal levels as well. Sadly the board had to address this when there are clearly more pressing issues at hand. Initiating this sad situation by this one board member is not what I elected her to do & therefore I will make sure to demonstrate my democratic prerogative at the next opportunity.

Problem is there shouldn't be politics at this level of Government. Past boards have had difference but were kept in focus for whats best for the district. The last 6+ years this board has really deteriorated away from a good focus. I do not vote for any incumbents anymore.

Publius, if you think this is all minutia then sadly you are the one that should get a clue. Her petition was not done correctly, it is not the first time she has had to do this, so she can't use the excuse "I didn't know". As Marie noted, temper tantrums because the person they want didn't do what she needed to do correctly! Oh well, Miller has appealed, so now she can see what the court says. I also agree with sells, both Broderick and Smith have the guts to stand up to Sass and the rest of the bullies on that board. They both consistently challenge what is not right for the kids. It is too bad the rest of the board and and anyone throwing their temper tantrums don't do the same.

I do not disagree with anything said. What's funny is they have the guts to stand up to Sass. Sass reports to the board and can be fired by the board. That is the tail wagging the dog!

50 signatures is minutia. I admit that the form was not correct. That's not the issue. The issue seems to be petty personal grudges distracting from primary concerns and a board member disregarding proper etiquette in an effort to carry out what appears to be a personal vendetta. This type of political behavior is improper, counter-productive, and quite possible illegal. The mere fact that it has progressed to this stage proves my point. Having political differences is a good thing - but in today's atmosphere we see that this type of thing is becoming typical and causing paralysis of our governing bodies. Stop the petty bickering that serves no purpose - and just do what you were elected to do. If in the minority, exercise your right to express your viewpoint but get on with the job. Making an issue of page whatever on a petition that requires 50 signatures has nothing to do with improving our schools.

Simple bait and switch tactics. Look here at the show in the left hand, look at all of the fighting and bickering. All the while, the right hand is stabbing us in the back, taxing us to death and doing our children an injustice by allowing our standards to sink.
I got news for you everyone. Both of our school districts are sinking. Sort of like the Italian cruise liner. You know the script, The captains bail right before the ship sinks. See you Sass and Wylie. We are screwed when it comes down to the near future. They see the handwriting on the wall,

I'm so glad to finally see someone stand up to the so-called "system" that runs New Lenox. The connections and back-room activities are common knowledge around here for most of us - and someone has finally stood up for what's right. Sass, Wylie, Eddy and both district boards are all intertwined in a controlling, manipulative way that makes it almost impossible to know when votes are legit, decisions are made objectively or someone hasn't pulled a string somewhere to get what they want. Get over yourselves and your nitpicking. Let the woman run and let "WE THE PEOPLE" decide if she should be on the Board.

Well CMC had Ms. Miller did what she was supposed to do properly in the first place, then she would still be on the ballot. Had she secured more than the bare minimum signatures needed, this would not be a problem.

What I want to know is, are WE THE TAXPAYERS paying for her appeal??

It would be nice to find out why there is bad blood between Broderick and Miller. I am disappointed in both Miller and Broderick. It is just sad. It is also sad that DiSandro and Smith got sucked into this fiasco.

District 122 School Board does needs to clean their act, over the summer a member had to resign because of an embarrassing personal issue and now this.

Keep this in mind, who on the board voted for Sass’s pay raise a few years ago, when everyone else in America who did not lose their job had to take a pay cut or a pay freeze.
The school superintendent is not an entitled CEO : ). Seems that there are too many board members that just do what Sass wants. I personally plan on voting for Smith as least she has the balls to question Sass.

This incident is just another example of time, resources, and funds taken away from the mission of the District -- teaching children. If we are to lead by example, what are our children learning? And do we need, yet, another reminder that some of the board members don't play nice? Trust the residents of New Lenox, Board Members, we all know. With the recent events (Sandy Hook), the focus would be to assess our schools' safety or providing some type of training for the faculty. The Board will always have their issues because you're dealing with a variety of personalities/opinions, but this is ridiculous. Do the job at hand; grow up; and stay focused on the kids.

Mr.Koehmstedt, the information I stated is available to the public. It plays into what transpired last night in my opinion because your wife said she is concerned about the money being spent in the district. You are not the first or last teacher to get a hefty salary bump in your last year of teaching. These kinds of raises are of concern to most taxpayers because it certainly plays a large part into what we pay over the course of one's retirement. If we are concerned about money being spent by the board in instances that require the district's attorney, then large raises given in the final year of teaching should be of concern too.

Before you throw the secretary of the board under the bus, if all the information was the same except the secretary let Kathleen Miller run and if someone was running against Kathleen Miller and they lost, wouldn't they have the right to file suit against the board and the secretary of the board for not doing her appointed JOB. And wouldn't this lawsuit cost the school board something to defend against it. And even if the school board has insurance for this type of thing would not the insurance rates increase. It's amazing how some people are upset because someone does not do their job yet others are as upset for that same person doing their job. There is a procedure that everyone follows. If you are not informed enough to follow the procedure and you informed enough to be on the board?

The great thing about only looking at something from one side is that you do not need a discussion; you only need to make up your mind. The bad thing is you might not be looking at the whole picture. I believe parents use "if" all the time even with their older children. IF you don't do your homework you will be ___. IF you are not home by 10 PM you will be ____. In fact, the government uses IF all the time when it comes to application of laws. IF you drive over the speed limit and are caught you will be _____. I guess I think IF is used by more than young children but please enlighten me.

So only people with little minds use IF, that does sound better. And the FACTS are that the secretary did her JOB regardless of politics.

Totally agree David H! If she had taken the time to go over the paperwork and make sure it was complete, or had she gathered more than the bare minimum signatures needed, this article would not be necessary. Since she did not follow proper procedures, she does not belong on the ballot.

I do want to know if her appeal is being paid by taxpayers or by her personally? I would imagine since this is not a district problem, the costs are being paid by Ms. Miller.

The last time I ran for Park District Board my petitions were challenged and I bared the cost to fight the challenge. It was for re-election. I would think an appeal would not be any different.
